Agreement to Terms
These Terms of Service (“Terms”) are a legally binding agreement between you (“Client,” “you,” or “your”) and Datahouse Marketing, Inc. (“Datahouse,” “we,” “our,” or “us”).
By accessing or using our website or SmartAppend™ data services, you agree to be bound by these Terms.
If you do not agree, you must discontinue your use of the services.
Who We Are
Datahouse Marketing, Inc. provides:
- Data enhancement and enrichment
- SmartAppend™ diagnostics and reporting
- CASS/DPV and NCOA processing
- Direct-mail data hygiene services
- Deliverability and targeting improvement

Eligibility
To use our services, you must:
- Be at least 18 years old
- Be a business entity or an authorized business representative
- Use our services only for lawful, B2B purposes
Our services are not intended for minors or personal consumer data processing unless legally permissible.
Services Provided
SmartAppend™ and related services may include:
- Customer dataset uploads
- Data cleansing and standardization
- Data enrichment and matching
- Reporting and analysis
- Quality scoring and diagnostics
- File preparation for direct mail campaigns
We do not guarantee match rates, append depth, or perfect accuracy of third-party datasets.
Client Responsibilities
You agree that:
- You have the legal right to provide any data uploaded for processing
- Your data does not violate privacy laws
- You will not upload sensitive or prohibited data categories without legal authorization
- You will not use our services for illegal or discriminatory activities
- Compliance with governance (CCPA, GDPR, CAN-SPAM, TCPA, postal regulations) is your responsibility
Data Handling & Confidentiality
A. Uploaded Files
Client-submitted data files are used solely to perform your requested service and are retained only as long as necessary.
B. Confidentiality
We treat all uploaded information as confidential.
We do not sell, rent, or repurpose customer-file data.
C. Security
We use industry-standard security measures, including encrypted connections, access controls, and secure hosting.
Fees & Payments
- Pricing is provided at the time of purchase or quotation
- Payments must be made according to the agreed terms
- Once data processing begins, fees are non-refundable
- Disputes or chargebacks may result in account suspension
Third-Party Services
We may use third-party providers for:
- Postal validation
- Data matching
- Hosting
- Security
- Analytics
We are not responsible for:
- Vendor inaccuracies
- Downtime
- System interruptions
- Postal delays
Your continued use constitutes acceptance of these limitations.
Intellectual Property
You may request:
All materials, reports, tools, processes, and methods provided by Datahouse Marketing remain our exclusive intellectual property.
You may not:
- Reproduce
- Redistribute
- Reverse-engineer
- Use for competitive analysis
- Republish
without written permission.
Prohibited Uses
You agree not to use our services for:
- Fraudulent activities
- Spamming or harassment
- Illicit targeting
- Violations of advertising laws
- Resale of enriched or appended datasets
- Activities that could harm our systems or reputation
Disclaimer of Warranties
Our services are provided “as is” and “as available.”
We do not guarantee:
- Accuracy of appended data
- Specific match rates
- Postal deliverability
- Uninterrupted system access
Data enhancement is inherently probabilistic.
Limitation of Liability
To the fullest extent permitted by law:
- Datahouse is not liable for indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount paid for the specific service in dispute
This includes losses relating to:
- Revenue
- Business interruption
- Data errors
- Vendor service interruptions

Indemnification
You agree to indemnify and hold harmless Datahouse Marketing, Inc. from any claims, liabilities, or damages arising from:
- Your misuse of data
- Violation of these Terms
- Unauthorized data submission
- Regulatory or compliance breaches
Termination
We may suspend or terminate services if:
- Payments are not received
- Terms are violated
- Fraud or abusive behavior is suspected
- Technical or legal issues require termination
You may discontinue use at any time.
Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Venue for any permitted legal claims shall be in the courts of: El Paso County, Colorado.
Binding Arbitration & Class-Action Waiver
A. Mandatory Arbitration
Any dispute or claim arising out of your use of our services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA). Arbitration shall be conducted in Colorado, unless both parties agree otherwise.
B. No Jury Trial
You waive your right to a court trial or jury trial.
C. Class-Action Waiver
You agree that arbitration must be conducted only on an individual basis, and not in any class, collective, or representative action. You waive the right to participate in class actions against Datahouse Marketing, Inc.
D. Arbitrator Authority
The arbitrator shall have exclusive authority to resolve any disputes relating to:
- Interpretation of these Terms
- Enforceability of arbitration provisions
- Scope of arbitration
Force Majeure
Datahouse Marketing, Inc. is not liable for any delay or failure to perform due to circumstances beyond our reasonable control, including:
- Natural disasters
- Power outages
- Internet or hosting failures
- Postal service disruptions
- Data-vendor downtime
- Government actions
- War, civil unrest, terrorism
- Public emergencies or pandemics
Performance will resume as soon as the cause is resolved.
Changes to These Terms
We may revise these Terms at any time.
By continuing to use our website or services after changes are posted, you accept the revised Terms.
